Terms of service
OVERVIEW
Welcome to R&A Clay Jewelry.
The terms “we”, “us” and “our” refer to R&A, operated by Remia Michl. R&A operates the R&A Clay Jewelry online store and website, including the related information, content, features, tools, products and services provided through the store (the “Services”).
Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
These Terms of Service (“Terms”) describe the conditions that apply when you access our website or purchase products from us.
Nothing in these Terms limits or excludes any mandatory rights you may have as a consumer under applicable law.
SECTION 1 — SELLER INFORMATION
The seller and contractual partner for purchases made through R&A Clay Jewelry is:
Remia Michl
R&A
Jahnstraße 16
82538 Geretsried
Germany
Email: rastreetwear2025@gmail.com
Telephone: +49 16098480110
Further legal information about the provider of this website can be found in our Legal Notice (Impressum).
SECTION 2 — SCOPE AND ACCESS TO OUR STORE
These Terms apply to the use of our online store and to contracts for products purchased through R&A Clay Jewelry.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.
When using our website or placing an order, you must provide accurate, current and complete information where requested.
If you create a customer account, you are responsible for keeping your account credentials confidential and for activity conducted through your account.
SECTION 3 — OUR PRODUCTS
We make reasonable efforts to describe and display our products accurately.
Because many R&A Clay Jewelry pieces are handmade, slight variations in color, shape, pattern, texture, placement and finish may occur between individual pieces. These variations are part of the handmade nature of the products.
Colors may also appear slightly different depending on your screen, device and display settings.
Product descriptions, materials, dimensions and other relevant characteristics are provided on the respective product pages.
We may change our product range or discontinue products at any time. This does not affect orders for which a contract has already been concluded.
SECTION 4 — ORDERS AND CONCLUSION OF CONTRACT
The presentation of products in our online store does not constitute a legally binding offer to conclude a purchase contract. It allows you to submit an order.
You may place selected products in your shopping cart and review your order before submitting it. Before completing checkout, you have the opportunity to identify and correct input errors.
By clicking the button that submits your order with an obligation to pay, you submit a binding offer to purchase the products contained in your order.
After you place your order, you may receive an automated acknowledgement confirming that we received it. Unless that communication expressly states otherwise, an acknowledgement of receipt does not itself constitute acceptance of your offer.
The purchase contract is concluded when we expressly accept your order, send confirmation that the order has been accepted, or dispatch the ordered goods.
If we cannot accept your order, we will inform you and refund any payment already received for that order.
SECTION 5 — PRICES AND PAYMENT
The prices displayed in our online store at the time an order is placed apply to that order.
Applicable taxes are handled and displayed according to the tax rules applicable to our business and the relevant transaction.
Any additional shipping charges are displayed separately during checkout before you submit your order.
Available payment methods are shown during checkout.
You must provide accurate and complete payment and billing information and must be authorized to use the payment method selected.
SECTION 6 — SHIPPING AND DELIVERY
We ship to the countries and regions available for selection during checkout.
Shipping costs, processing times and estimated delivery times are described in our Shipping Policy and/or displayed during checkout.
Many of our products are handmade or prepared after an order is received. Any stated processing time is therefore additional to the carrier's estimated transit time unless expressly stated otherwise.
Delivery and transit times are estimates unless a binding delivery date has expressly been agreed.
For purchases made by consumers, the statutory provisions regarding delivery and transfer of risk apply.
If your order arrives damaged, incomplete or incorrect, please contact us promptly at rastreetwear2025@gmail.com so that we can investigate and assist you.
SECTION 7 — RIGHT OF WITHDRAWAL
Consumers may have a statutory right of withdrawal (Widerrufsrecht) for distance contracts in accordance with applicable consumer law.
Information concerning the conditions, time limits and procedure for exercising the right of withdrawal, as well as the consequences of withdrawal, is provided separately in our Withdrawal Instructions (Widerrufsbelehrung).
Where the statutory right of withdrawal applies, the withdrawal period is generally 14 days.
The statutory right of withdrawal is separate from any additional voluntary return policy we may offer.
SECTION 8 — EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
The statutory right of withdrawal does not apply where an exception provided by applicable law applies.
This may include, in particular, contracts for the supply of goods that are not prefabricated and for whose production an individual choice or specification by the consumer is decisive, or goods that are clearly tailored to the consumer's personal needs.
An item being handmade or produced after an order is received does not by itself mean that the statutory right of withdrawal is excluded.
Where a statutory exception applies to a particular product, we will provide the relevant information as required by law.
SECTION 9 — RETURNS, REFUNDS AND DEFECTIVE PRODUCTS
Our Refund Policy contains additional information about returns and refunds.
Nothing in our Refund Policy or these Terms limits mandatory statutory consumer rights.
Statutory warranty rights apply to defective goods.
If an item is defective, damaged, incomplete or different from the item ordered, please contact us at rastreetwear2025@gmail.com.
SECTION 10 — INTELLECTUAL PROPERTY
Unless otherwise stated, the original content made available through R&A Clay Jewelry, including text, product photographs, graphics, logos, designs and other original materials, is owned by us or used with appropriate authorization and is protected by applicable intellectual property laws.
You may use our website and its content for personal, non-commercial purposes.
You may not reproduce, distribute, republish, commercially exploit or create derivative works from our protected content without prior permission unless such use is permitted by applicable law.
Shopify's names, logos, trademarks and other intellectual property belong to Shopify or its respective rights holders.
Other third-party trademarks, names and materials remain the property of their respective owners.
SECTION 11 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES
Our Services may provide access to features, tools or services supplied by third parties.
Your use of third-party services may also be subject to the terms and privacy policies of the relevant third-party provider.
We are not responsible for third-party services to the extent that responsibility rests with the respective third-party provider under applicable law.
Nothing in this section excludes liability that cannot legally be excluded.
SECTION 12 — THIRD-PARTY LINKS
Our website may contain links to websites or services operated by third parties.
These links may be provided for convenience or because a third-party service is used in connection with our store.
We do not control third-party websites and are not responsible for their content, availability or practices except where responsibility is imposed on us by applicable law.
Before purchasing products or services from a third party, you should review that provider's applicable terms and privacy information.
SECTION 13 — RELATIONSHIP WITH SHOPIFY
R&A Clay Jewelry is powered by Shopify, which provides the e-commerce platform that enables us to operate our online store.
However, purchases made from R&A Clay Jewelry are made directly between you and R&A as the seller. Shopify is not the seller of R&A Clay Jewelry products.
R&A is responsible for the products offered through this store and for the purchase contracts concluded with our customers.
Shopify may separately provide certain consumer-facing services, such as Shop or Shop Pay. Where you use such a service, separate terms or privacy information provided by Shopify may apply to that service.
SECTION 14 — PRIVACY AND DATA PROTECTION
Personal information collected through our Services is processed in accordance with our Privacy Policy and applicable data protection law.
Because our online store is powered by Shopify, Shopify and other service providers may process personal information where necessary to provide the store, payment, technical and related services.
Please review our Privacy Policy for further information about how personal information is collected, used, shared and protected.
SECTION 15 — FEEDBACK AND REVIEWS
If you voluntarily submit a product review, comment, suggestion, photograph or other feedback to us, you confirm that you have the necessary rights to submit that material.
You must not submit content that infringes the rights of another person or that is unlawful.
To the extent necessary to display, reproduce and use feedback or reviews that you submit for our store or business, you grant us a non-exclusive right to use that material for those purposes, subject to applicable law and any rights you retain.
Nothing in this section transfers ownership of your intellectual property to us beyond the rights reasonably necessary for the permitted use.
SECTION 16 — ERRORS AND INACCURACIES
Despite reasonable care, our website may occasionally contain typographical errors, inaccurate information or omissions concerning matters such as product descriptions, availability, prices or shipping information.
We may correct errors and update information where appropriate.
If an error affects an order that has already resulted in a binding contract, your statutory rights remain unaffected.
SECTION 17 — PROHIBITED USES
You may use our website only for lawful purposes.
You must not use our Services:
• for unlawful or fraudulent purposes;
• to infringe our intellectual property rights or the rights of others;
• to transmit malicious software, viruses or other harmful code;
• to interfere with the security or proper operation of our website;
• to collect personal information unlawfully;
• to impersonate another person or misrepresent your identity;
• to send unlawful spam or other unauthorized communications; or
• to access or use our Services in any other manner prohibited by applicable law.
We may take reasonable measures to protect the security and operation of our store where misuse occurs.
SECTION 18 — AUTOMATED ACCESS AND AGENTS
Automated systems, bots, scraping tools, software agents and similar technologies must not access or interact with our Services in a way that violates applicable law, circumvents security measures, disrupts our Services or infringes the rights of R&A, Shopify, our customers or third parties.
We may use reasonable technical measures to protect our website against abusive or unauthorized automated access.
SECTION 19 — AVAILABILITY OF THE SERVICES
We make reasonable efforts to keep our online store available and functioning properly.
We cannot guarantee uninterrupted availability of the website because maintenance, technical problems, internet disruptions, third-party services or circumstances outside our reasonable control may temporarily affect availability.
Nothing in this section affects liability or consumer rights that cannot legally be excluded or restricted.
SECTION 20 — LIABILITY
We are liable without limitation for damage caused intentionally or through gross negligence and for injury to life, body or health where required by law.
We are also liable in accordance with mandatory statutory provisions, including applicable product liability law.
In the case of a slightly negligent breach of an essential contractual obligation, liability is limited, to the extent permitted by law, to the foreseeable damage typical for the contract.
An essential contractual obligation is an obligation whose fulfillment is necessary for the proper performance of the contract and on whose fulfillment the customer may ordinarily rely.
Any further limitation or exclusion of liability applies only to the extent permitted by applicable law.
Mandatory statutory consumer rights remain unaffected.
SECTION 21 — TERMINATION OR RESTRICTION OF WEBSITE ACCESS
We may restrict or terminate access to our website where reasonably necessary, particularly in cases of unlawful use, security threats, fraud or material violations of these Terms.
Termination or restriction of website access does not affect rights and obligations arising from purchase contracts already concluded, except where applicable law provides otherwise.
SECTION 22 — SEVERABILITY
If any provision of these Terms is or becomes invalid, unlawful or unenforceable, the remaining provisions remain unaffected to the extent permitted by applicable law.
Mandatory statutory provisions apply in place of any invalid provision where required.
SECTION 23 — GOVERNING LAW
The law of the Federal Republic of Germany applies to these Terms and to contracts concluded with us, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent that such exclusion is legally permissible.
If you are a consumer and have your habitual residence in another country, this choice of law does not deprive you of mandatory consumer protection provisions that apply under the law of your country of habitual residence.
Nothing in this section restricts any mandatory jurisdiction or consumer protection rights available to consumers under applicable law.
SECTION 24 — CHANGES TO THESE TERMS
We may update these Terms from time to time, for example to reflect changes to our Services, business operations or applicable legal requirements.
For a purchase contract, the version of these Terms applicable when the order is placed will generally apply to that order unless applicable law requires otherwise.
The current version of these Terms can be reviewed on our website.
